Medical Advertising Protection Act

The Drug Advertising Protection Act includes "means, methods, treatments and objects to the extent that the advertising message refers to the detection, removal or alleviation of disease, illness, physical defects or pathological symptoms in people". The main goal of genetic testing offers is concerned with recognizing a genetic variation which triggers a risk of a disease in healthy people, and the prevention of the disease by lifestyle changes. Since there are no "diseases, ailments, physical damage or pathological symptoms" during the whole process of preventive genetic analysis, the Drug Advertising Protection Act does not apply.

Some of the analyses offered provide valuable information for the treatment of the already infected, but these aspects of genetic testing are deliberately and consciously excluded from the advertising claims. This advertising does not fall under the sphere of influence of the Drug Advertising Protection Act.
